Amazon Haul - Applicable Terms and Conditions

Welcome to the Amazon UK Haul Store. The Amazon UK Haul Store and related websites, apps and services are provided by Amazon Europe Core SARL and/or its affiliates and your use is governed by the Amazon.co.uk Conditions of Use.

Products may be sold to you on the UK Haul Store ("Haul Products") by:

  • Amazon EU SARL. The Amazon.co.uk Conditions of Sale govern the sale of Haul Products by Amazon EU SARL, except as stated below in relation to returns;
  • Third party ("3P") sellers. Please refer to section 11 of the Amazon.co.uk Conditions of Use in relation to sales of Haul Products by 3P sellers; or
  • Amazon Export Sales LLC ("Haul Global", "Amazon US", "we" or "us") ("Haul Global Products"). The Amazon Global Haul Customer Terms and Conditions set out below govern the sale of Haul Global Products by Amazon US.

In addition to the above terms, for all Haul Products, you may request a return within 15 days of delivery. Please see the Amazon Haul section of the Returns Policy for details. For Haul Products sold by Amazon EU Sarl, please note that this 15-day returns policy applies instead of the 30-day voluntary returns guarantee mentioned in the Amazon.co.uk Conditions of Sale.

Amazon Global Haul Customer Terms and Conditions

These terms and conditions ("Conditions of Sale") apply to Haul Global Products which are sold to you by Amazon US. For details of the different terms which apply to Haul Products sold by Amazon EU Sarl and 3P sellers, please see the section above.

Responsibility for Importation, Import Duties and Taxes

When purchasing Haul Global Products, you acknowledge that the sale occurs outside the UK and Haul Global Products are stored and shipped from fulfillment center(s) in a country outside the UK, so your order will need to clear customs before it is delivered to you. To enable fulfillment carriers and agents to clear your order through the border on your behalf, you agree to the following:

  1. You are buying the Haul Global Products for personal use and not for resale or any commercial use.
  2. You authorize Amazon US to designate fulfillment carriers ("Designated Carriers") to act as your agent with the relevant customs, postal, and tax authorities ("Government Authorities") to clear your Haul Global Products through the UK border and to process any amendments, invalidations, or duty refunds or remissions related to the importation of your Haul Global Products.
  3. You will be listed as the purchaser, consignee (ship-to address), and importer for your order and act as the declarant for customs purposes, unless another party is required by applicable law to be listed as the importer. In that case, you authorize Amazon US or the Designated Carriers to designate an importer. An importer is the person responsible for the import clearance of products shipped from outside of the UK.
  4. Your order may be subject to local taxes in the UK. If applicable, you are responsible for paying any taxes, customs duties, and fees levied by Government Authorities in the UK ("Import Duties and Taxes") which are triggered by the importation by you of Haul Global Products into the UK. Where Import Duties and Taxes are due, as the declarant, you are solely responsible for paying them, and you authorize the Designated Carriers to pay them to the Government Authorities on your behalf.
  5. Where applicable, we will charge you a fixed amount at checkout to cover all applicable customs-related processes and costs including Import Duties and Taxes ("Import Charge"). Import Charges are a fixed amount and represent a fee. If we charge you an Import Charge, you'll see it at checkout. If your order qualifies for certain types of import processes, there may be no Import Duties and Taxes. We will use the Import Charge you pay to reimburse the Designated Carriers for the actual Import Duties and Taxes charged by Government Authorities. You allow the Designated Carriers to tell Amazon US the amount of the actual Import Duties and Taxes for your Haul Global Products. We will not charge you any additional amount if the actual Import Duties and Taxes are greater than the Import Charge you paid.

Customs Inspections and Information

Imports are subject to opening and inspection by customs and/or postal authorities. We may provide certain order, shipment, and product information, such as product names or titles, to the international carriers or agents, and such information may be communicated by the carriers or agents to Government Authorities in order to facilitate customs clearance and comply with local laws.

Our Contract

With respect to products sold in the Amazon UK Haul Store, your order is an offer to Amazon US for you to buy the Haul Global Product(s) in your order. When you place an order to purchase the Haul Global Product(s), you will be sent a message confirming receipt of your order and containing the details of your order (the "Order Confirmation"). Your order information will also be available on the "Your Orders" page in the Amazon UK Haul Store. The Order Confirmation is acknowledgement that Amazon US has received your order, and does not confirm acceptance of your offer to buy the Haul Global Product(s) ordered. Amazon US only accepts your offer, and concludes the contract of sale for Haul Global Product(s) ordered by you, when it dispatches the product(s) to you and sends an e-mail confirming the dispatch of the product to you (the "Dispatch Confirmation"). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation for each package, and each Dispatch Confirmation and corresponding dispatch will conclude a separate contract of sale between you and Amazon US for the Haul Global Product(s) specified in that Dispatch Confirmation.

Please note that we sell Haul Global Product(s) only in quantities which correspond to personal use and we may refuse orders for quantities that we determine are for commercial purposes. This applies both to the number of Haul Global Products ordered within a single order and the placing of several orders for the same or similar Haul Global Products.

Despite Amazon US' best efforts, a small number of the items in the Amazon UK Haul Store may be mispriced. If Amazon US has made a mistake and a Haul Global Product's correct price is higher than the price in the Amazon UK Haul Store, Amazon US may either contact you before shipping to request whether you want to buy the Haul Global Product at the correct price or cancel your order. Amazon US may be required to cancel or limit orders from time to time where there has been a genuine price error.

Risk of Loss

All purchases of Haul Global Products are made pursuant to a shipment contract. This means that the risk of loss and title for Haul Global Products pass to you after Haul Global Products are cleared for export from the ship-from country outside the UK.

Product Information

Unless expressly indicated otherwise, Amazon US is not the manufacturer of the Haul Global Products. While Amazon US works to ensure that product information for Haul Global Products is correct, Haul Global Products and any product packaging and materials may be different from that displayed on the Amazon UK Haul Store. All information about Haul Products on the Amazon UK Haul Store is provided for information purposes only. To the extent permitted by law, Amazon US' sole liability in the event of any incorrect product information will be to accept a return of the Haul Global Product in accordance with the Haul returns policies and any other rights you may have under law. We recommend that you do not rely solely on the information presented on the website. Please always read labels, warnings and directions provided with the Haul Global Product before use.

In the event of any safety concerns or for any other information about a Haul Global Product, please carefully read the information provided with the Haul Global Product, contact the manufacturer, or report the concern to us.

To the extent permitted by law, the Amazon UK Haul Store accepts no liability for inaccuracies or misstatements about Haul Global Products by manufacturers or other third parties.

Returns and Refunds

When you request to return an Haul Global Product, the Amazon UK Haul Store may (at its sole discretion) elect to issue a refund without requiring a return, or require that you return the product to an address located in the UK ("Local Return Destination").

If you are required to return the Haul Global Product to a Local Return Destination, Amazon US will decide (in its sole discretion) whether to forward the product to an address that is outside the UK ("International Return Destination"), or otherwise how to handle it. By initiating the returns process, you expressly authorize Amazon US to handle the returned Haul Global Product on your behalf. If the returned Haul Global Product is ultimately forwarded to an International Return Destination, you will be responsible for clearing the goods (as exporter of record), and you authorize us to do so on your behalf by allowing Amazon US to designate a carrier who will act as your direct or indirect representative/agent with the relevant Government Authorities in the country of exportation.

Disclaimer and Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, AMAZON US: (i) DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; and (ii) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. Unless otherwise stated in writing, our liability to you for any loss arising from or relating to the offer or sale of any Haul Global Product by us on the Amazon UK Haul Store is limited to a refund of the relevant amount paid for the Haul Global Product (including applicable shipping fees).

Updates

We reserve the right to make changes to its terms, conditions, and policies, including these Conditions of Sale at any time by posting the changes on our website. You will be subject to the terms, conditions, policies, and Conditions of Sale in force at the time that you purchase Haul Global Products.

If any of these Conditions of Sale are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Waiver

If you breach these Conditions of Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale.
