These terms of use (“Terms”) for Kindle Unlimited (the “Service”) are an agreement between you and Amazon Media EU S.à r.l. (with its affiliates “Amazon”, “We” or “Us”). Your Kindle Unlimited membership is also governed by the agreements listed and linked to below. Please also see our Privacy Notice (https://www.amazon.co.uk/privacy), our Cookies Notice and our Interest Based Ads Notice, to understand how we collect and process your personal information.
We will provide the Service immediately from the moment you click to start your membership.
1. The Service.
As a member of Kindle Unlimited you may read Kindle books and magazines, and listen to Audible audiobooks from a designated list of titles (collectively the “Subscription Content”) an unlimited number of times for so long as you are a member of the Service.
2. Availability of Subscription Content.
The catalogue of Subscription Content is constantly changing, and new Subscription Content may be added, and existing Subscription Content removed, at any time. The Service is currently only available to customers located in the United Kingdom, (including Gibraltar, Jersey, Isle of Man and Guernsey) and Ireland.
3. Personalization.
We personalize introductory and promotional offers, content and features as part of the Service, for example by showing you recommendations which might be of interest to you. We may use automated processes based on your previous activity on Amazon to provide this personalized service.
4. Your Legal Rights.
We supply the Service in accordance with these Terms. If the Service, or any part of it, is defective or not as described, then the laws of your country may give you rights and remedies in addition to your rights under these Terms. More details about your legal rights can be found here.
5. Fees and Renewal.
From time to time, we may offer different membership options or introductory offers, and the fees for such memberships may vary. Membership fees will include tax where applicable and are non-refundable except as expressly set out in these Terms.
We accept credit and debit cards for payment of your membership fees.
We may change the Kindle Unlimited membership fee from time to time by notifying you of the change and effective date before it takes effect. At any time before a membership fee change takes effect, you may reject the change by turning off auto-renewal of your membership; see section 7 (“Turning Off Auto-Renewal Of Your Membership”) below.
At the end of each membership period, we will charge your designated payment method the Kindle Unlimited membership fee, and your membership will renew automatically for a further membership period, unless you notify us in advance that you want to turn off auto-renewal your membership. You understand your Kindle Unlimited membership will automatically continue and you authorize us (without notice to you, unless required by applicable law) to collect the then-applicable membership fees and any taxes, using any payment method we have on record for you.
If your designated payment method fails or is declined for any reason, we may charge any alternative payment method on file with your Amazon account. If all payment methods we have on file for you fail or are declined, we will notify you and we may ask you to provide an alternative payment method or ensure your specified payment method has sufficient funds by a specified date. You may lose access to your membership until we are able to take payment. If we are unable to take payment by the specified date, your membership will be cancelled. If you provide us with a new payment method and are successfully charged before your membership is cancelled, your new membership period will be based on the original renewal date and not the date of the successful charge.
6. 14 Day Right of Cancellation/Withdrawal.
If you paid your membership fee when you joined Kindle Unlimited (i.e. you did not take a free trial offer), and you want to withdraw from your membership and receive a full refund, you can do so by contacting Customer Service and informing them of your withdrawal within 14 days of the date on which you signed up.
7. Turning Off Auto-Renewal Of Your Membership.
You can turn off your membership at any time by visiting www.amazon.co.uk/kucentral, clicking the 'Cancel membership' button and following the instructions on your screen to turn off auto-renewal of your Kindle Unlimited membership, or by contacting our Customer Service team. If you turn off auto-renewal of your Kindle Unlimited membership, then (i) you will continue to enjoy access to Subscription Content and any other Kindle Unlimited benefits until the end of your membership period; (ii) you will not receive a refund of any membership fees already paid; (iii) at the end of your membership period, your Subscription Content will be removed from your account, devices and applications; and (iv) if you turn off auto-renewal of your Kindle Unlimited membership before the renewal date, you will not be charged for the next subscription period.
If you paid your membership fee when you joined Kindle Unlimited (i.e. you did not take a free trial offer), and you choose to turn off your membership within 14 days of the date on which you signed up, we will refund your membership fee. You can turn off your membership by visiting www.amazon.co.uk/kucentral or the “Your Memberships & Subscriptions” section within Your Account on Amazon.co.uk.
8. Restrictions.
We reserve the right to refuse or cancel your membership if we have a valid reason to do so, such as if your payment method has insufficient funds, for security or legal reasons, or if we have reasonable grounds to believe that you have fraudulently used the Service. You may not transfer your membership or any Kindle Unlimited benefits to anyone else. We may take reasonable actions necessary to prevent fraud or abuse, including placing restrictions on the number of titles that can be accessed from the Service using your account at any one time, or the number of devices that can be used to access Subscription Content under your membership.
9. Promotional Trial Memberships.
We sometimes offer customers trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the details or applicable terms for those promotional offers. Trial members may choose not to continue to paid membership at any time during their trial period, by choosing not to auto-renew their membership; see section 7 (“Turning Off Auto-Renewal Of Your Membership”) above for details of how to turn off auto-renewal.
10. Terms Changes; Updates and Modification of the Service.
Terms Changes. We may change these Terms for legal, regulatory, security, or operational reasons, including to reflect a change to the Service. You are subject to the Terms in force and published on Amazon.co.uk at the time that you use the Service.
Updates and Modifications of the Service. We may update, suspend, discontinue or otherwise modify the Service, or any part of it, for legal, regulatory, security, or operational reasons, including to reflect enhancements or other improvements to the Service. If a change materially and adversely impacts the usability of the Service, we will inform you in writing in advance before the changes are effective. If you do not wish to accept a change to the Service, you may choose not to auto-renew your membership, see section 7 (“Turning Off Auto-Renewal Of Your Membership”).
11. Termination by Us.
We may terminate your membership if, for example, we choose not to continue to offer the Service by giving at least 30 days’ notice (or a shorter notice period if required by law, regulatory action or a court decision). If a termination takes effect before the end of your membership period, we will give you a prorated refund of your membership fee based on the number of days remaining in your membership.
We may terminate your Kindle Unlimited membership immediately, without providing any refund, if:
(a) your use of the Service materially breaches these Terms or any applicable law;
(b) we have reasonable grounds to believe that you have fraudulently used the Service; or
(c) we cannot lawfully provide the Service to you.
We may also terminate your account if it is inactive for a sustained period. We will contact you and give you advance notice before doing so.
Amazon’s failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of its rights.
12. Our Liability; Applicable Law.
Any dispute or claim arising from or relating to these Terms or your Kindle Unlimited membership is subject to the Applicable Law and Our Liability sections in the Amazon.co.uk Conditions of Use. References in those sections to the Conditions of Use or “these conditions” shall, for the purposes of these Terms only, be interpreted as referring to these Terms. Nothing in these Terms limits or excludes our responsibility to you where it would be unlawful to do so. This includes responsibility for fraudulent representations made by us, for death or personal injury caused by our negligence, or for breach of your legal rights in relation to the Service.
13. Children.
Kindle Unlimited is for customers aged 18 or over. If you are under 18 years of age, you may use the Service only with permission from your parent or guardian.
14. Severability.
If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
