These Kindle Store Terms of Use (“Terms”) and the Amazon.co.uk Conditions of Use & Sale (https://www.amazon.co.uk/conditionsofuse) (collectively, this “Agreement”) are an agreement between you and Amazon Media EU S.à r.l. (with its affiliates, “Amazon”, “us” or “we”). By using the Kindle Store, purchasing or using any Kindle Content, using any Kindle Software or using any aspect of the Service you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use the Kindle Store, any Kindle Content, any Kindle Software or the Service. If you subscribe to Kindle Unlimited, the separate Kindle Unlimited Terms of Use (https://www.amazon.co.uk/kindleunlimitedterms) will apply to your subscription.
For the purposes of this Agreement:
“Kindle Content” means digitised content obtained through the Kindle Store, such as books, newspapers, magazines, Periodicals and other content.
“Kindle Software” means software we make available that permits users to shop for, download, browse or use the Kindle Store or Kindle Content, or to create or distribute other content, such as notes and files, on a Supported Device, and includes all “Send to Kindle”.
“Kindle Store” means our stores, available through certain Kindle Software and on our website, the homepage of which is located at https://www.amazon.co.uk/kindle/store.
“Periodicals” means Kindle Content made available to you on a subscription basis, such as electronic newspapers, magazines, and other subscription-based content, except for Kindle Content made available through a Kindle Unlimited subscription.
“Service” means the provision of the personalized Kindle Store, Kindle Content, Kindle Software, and support and other services that we provide to Kindle Store, Kindle Content and Kindle Software users.
“Subscription Content” means Kindle Content made available for access only for so long as you remain an active member of a subscription or membership program, such as Kindle Unlimited or Amazon Prime.
“Supported Device” means a mobile, computer or other supported electronic device on which you are authorised to operate a Kindle Software, including a Kindle e-reader. For more information on Supported Devices, please see here (https://www.amazon.co.uk/supporteddevices).
1. Kindle Content
Use of Kindle Content. Upon your purchase or access of Kindle Content and payment of any applicable fees (including applicable taxes), Amazon grants you a non-exclusive right to view, use, and display such Kindle Content (for Subscription Content only for as long as you remain an active member of the underlying membership or subscription program), solely through Kindle Software or as otherwise permitted as part of the Service, on the Supported Devices specified in the Manage Your Content and Devices section within Your Account (which may change from time to time), and solely for your personal, non-commercial use. Kindle Content is licensed, not sold, to you by Amazon. Amazon may include additional terms of use within Kindle Content. Those terms will also apply, but this Agreement will govern in the event of a conflict. Some Kindle Content, such as interactive or highly formatted content, may not be available to you on all Kindle Software.
Availability of Kindle Content. The catalogue of Kindle Content on the Kindle Store, including any Subscription Content, is constantly changing, and new Kindle Content may be added, and existing Kindle Content removed, at any time.
Limitations. Unless specifically indicated otherwise, you may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to Kindle Content or any portion of it to any third party, and you may not remove or modify any proprietary notices or labels on Kindle Content. In addition, you may not attempt to bypass, modify, defeat, or otherwise circumvent any digital rights management system or other content protection or features used as part of the Service.

Periodical Subscription Cancellations.
If you subscribe to a Periodical, the duration of your subscription to that Periodical will be specified at the time of purchase. You can cancel your subscription to a Periodical at any time by visiting the “Your Memberships & Subscriptions” section within Your Account and updating your subscription settings. If you cancel your subscription to a Periodical, the cancellation of your subscription will be effective immediately and you will receive a prorated refund based on the number of days remaining in your subscription.
You may also cancel your subscription to a Periodical within 14 days of the date on which you first subscribed and receive a full refund for that subscription by visiting the “Your Memberships & Subscriptions” section within Your Account.
We may terminate your subscription to a Periodical immediately, without providing any refund, if:
a) your use of the Service materially breaches this Agreement or your use of the Service breaches any applicable law;
(b) we have reasonable grounds to believe that you have fraudulently used the Service; or
(c) we cannot lawfully provide the Service to you.
We may also terminate your subscription to a Periodical if Amazon no longer has the right to provide a Periodical, or if Amazon chooses not to continue to offer a Periodical, by giving at least 30 days’ notice (or a shorter notice period if required by law, regulatory action, or a court decision), and if such a termination takes effect before the end of your subscription period, we will give you a prorated refund of your subscription fee based on the number of days remaining in your subscription.Periodical Subscription Fees. Your Periodical subscription fees are stated in the “Memberships & Subscription” section within Your Account. We reserve the right to change Periodical subscription terms and fees from time to time, effective as of the beginning of the next subscription term.
Risk of Loss. Risk of loss for Kindle Content transfers when you download or access Kindle Content.
2. Use of Kindle Software
Permitted Devices. You may use Kindle Software only on Supported Devices.
Importing, Sharing, and Distributing Content. The Service may allow you to import, upload, export, share, submit, or otherwise distribute, content to yourself or others (“Distribute”). You may not Distribute content that contains child sexual abuse or other abusive materials, or that advocates hatred, violence, or terrorism. You may only Distribute content to another if you have their permission; you may not Distribute content that is unsolicited. You may Distribute content solely for your personal, non-commercial use; you may not charge, directly or indirectly, to Distribute content via any Service. You are solely responsible for all content that you Distribute. Amazon takes no responsibility and assumes no liability for any content that you, or any third party, Distribute. Amazon may investigate any suspected violation or other misuse of any Service, and may review and remove any content and associated metadata.
Additional Software Terms. For additional terms that apply to Kindle Software, see the Additional Amazon Software Terms in the Amazon.co.uk Conditions of Use and any terms provided with Kindle Software (for example, in the Legal Notices or similar section).
3. Terms Changes; Updates and Modification of the Service
Terms Changes. We may change these Terms for legal, regulatory, security, or operational reasons, including to reflect a change to the Service. You are subject to the Terms in force and published on Amazon.co.uk at the time that you use the Service.
Updates and Modifications of the Service. We may update or otherwise modify the Service, or any part of it, for legal, regulatory, security, or operational reasons, including to reflect enhancements or other improvements to the Service. If a change materially and adversely impacts the usability of the Service, we will inform you in writing in advance before the changes are effective. If you do not wish to accept a change to the Service, you may cancel the Service.
4. General
Personalisation. We personalize content and features in the Kindle Store and as part of the Services provided in this Agreement, including by showing you recommendations on features, Kindle Content, and services which might be of interest to you.
Termination. Your rights under this Agreement will automatically terminate if you materially fail to comply with this Agreement, if your use of the Service breaches any applicable law, or if we have reasonable grounds to believe that you have fraudulently used the Service. In case of such termination, you must cease all use of the Service, and Amazon may immediately revoke your access to the Service without refund of any fees. Notwithstanding any termination, you will continue to have access to the Kindle Content already purchased by you up to that point (except as provided for in the “Periodical Subscription Cancellation” section). Amazon’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.
Suspension or discontinuation of the Service. We may discontinue the Service or any part of it at any time for legal, regulatory, security or operational reasons. We may also suspend the Service or restrict access to it for repair, maintenance, or updates.
Applicable Law; Our Liability. Any dispute or claim arising from or relating to these Terms or the Service is subject to the Applicable Law and Our Liability sections in the Amazon.co.uk Conditions of Use (https://www.amazon.co.uk/conditionsofuse).
References in that section to the Conditions of Use or “these conditions” shall, for the purposes of these Terms only, be interpreted as referring to these Terms. Nothing in these Terms limits or excludes our responsibility to you where it would be unlawful to do so. This includes responsibility for fraudulent representations made by us, for death or personal injury caused by our negligence, or for breach of your legal rights in relation to the Service.
Children. The Kindle Store is for customers aged 18 or over. If you are under 18 years of age, you may use the Kindle Store only with permission from your parent or guardian.
Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
