Amazon Dash Replenishment Terms of Use

Welcome to the terms of use for the product ordering service known as Amazon Dash Replenishment (the "Service," which includes Software and other support and related services). This is an agreement between you and Amazon EU S.à r.l. (with its affiliates, “Amazon” or “we”). Before using Amazon Dash Replenishment, please read these Amazon Dash Replenishment Terms of Use, the Amazon Device Terms of Use (if accessing the Service through a Device) the Amazon Discount Voucher Terms & Conditions (if applying a voucher to the Service), the Conditions of Use & Sale and all other applicable rules, policies, and terms posted on the Amazon.co.uk website or otherwise provided by Amazon, which also govern our respective rights and obligations (collectively, this “Agreement”). By using the Service, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use Amazon Dash Replenishment. Please also see our Privacy Notice, our Cookies Notice, and the Interest Based Ads Notice, which are not part of this Agreement.

Definitions: For the purpose of these Amazon Dash Replenishment Terms of Use:

"Order" means any product order placed using the Service.

"Device" means any Amazon approved and authorised Internet connected device that utilizes the Service, including but not limited to the Amazon Dash Button.

"Site" means any Amazon approved and authorized website, mobile application or other online point of presence that utilizes the Service.

"Software" means all software (including updates and upgrades to that software) and any related documentation that we make available to you or any third party maker of Devices or Sites for use in connection with the Service.

Eligibility. A list of eligible products that may be ordered through the Service, which is subject to change, is available from here for Amazon Dash Button and through Manage Your Content and Devices for other Devices. The Service is available to customers shipping to addresses in the United Kingdom. Orders placed through the Service are not currently eligible for AmazonSmile donations.

Offers, Orders, Cancellations and Returns. Offer and product details may change as you reorder the products through the Service over time (for example, price, taxes, availability, delivery charges, and the seller). Each Order will be subject to the offer details at the time you place the Order. You can review current offer and product details at any time before each purchase through the Service and see the details for each Order in Your Orders. If your product is unavailable when your Order is placed, we may fulfil your Order with a suitable replacement of the same type of product and of the same brand (e.g., with slightly different fill quantity). After an Order is placed, you have a window of time to review and confirm details and make any changes to, or cancel, that Order - to learn more, go to Change Your Order Information. You also may return your Order subject to the Amazon.co.uk Returns Policy.

Payment. Orders placed using the Amazon Dash Button will be charged to the payment method and delivered to the address associated with your 1-Click settings. Orders placed through Sites will be charged to your default payment method and delivered to your default shipping address. Orders placed using other Devices will be charged to the payment method and delivered to the address that you designate during Service setup. If your designated payment method is declined for payment, we may charge another payment method on file. For each Order placed using the Service, you will be charged the price (including VAT where appropriate) of each product on the day your Order is processed, as detailed in the Order Confirmation, less any applicable discounts. Amazon's standard delivery rates and policies apply. Any eligible promotions, discounts or rewards on your Amazon.co.uk customer account may be applied to your Order before charging any remaining amount to your payment method. Some Orders may be eligible for a voucher discount.

Devices and Use of Software. Devices require an Internet connection to access the Service. If your Device is located in an area in which it cannot maintain Internet connectivity, you may not be able to use some or all of the Service. You may use the Software only in connection with the Service. For additional terms that apply to the Software, see the Additional Amazon Software Terms contained in the Amazon.co.uk Conditions of Use & Sale and any additional legal & compliance notices contained on the Site used to setup your Device.

Devices include third party devices that Amazon does not manufacture or develop. Amazon has no responsibility or liability for such devices. If you use a third party Device, we may exchange Service related information with the maker of that device, such as your estimated Order delivery date and other Order related details. Your use of any third party Device is subject to this Agreement and any third party terms applicable to such Device. When using a third party Device, you are responsible for any information you provide to the third party. Any third party’s use of information you provide it will be subject to any privacy notice or other terms that the third party may provide to you. Makers of third party Devices may change or discontinue the functionality or features of their Devices.

Changes to the Service; Amendments. We may change, suspend, or discontinue any or all of the Service at any time. We may amend this Agreement at our sole discretion by posting the revised terms on the Amazon.co.uk website. Your continued use of the Service after the effective date of the revised Agreement constitutes your acceptance of the terms, including for any future Order placed using a previously configured Device or Site.

Termination. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Amazon may immediately revoke your access to the Service. Amazon’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

Applicable Law. Any dispute or claim arising from or relating to this Agreement, the Service or any Device or Site is subject to the applicable law, disclaimer of warranties, limitation of liability and all other terms in the Amazon.co.uk Conditions of Use & Sale. By using the Service, including by each press of an Amazon Dash Button, or each use of a Device or Site, you agree to be bound by those terms.

Exclusion of Liability. WITHOUT LIMITING THE EXCLUSION OF LIABILITY IN THE AMAZON.CO.UK CONDITIONS OF USE & SALE, UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL OUR OR OUR LICENSORS’ AGGREGATE LIABILITY UNDER THIS AGREEMENT WITH RESPECT TO ANY CLAIM EXCEED FIFTY POUNDS STERLING (£50.00). Nothing in this paragraph affects your statutory rights as a consumer or any liability for death, personal injury, or fraud.

Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
