Prime Try Before You Buy Terms & Conditions

Amazon EU S.à r.l. and/or its affiliates ("Amazon" or "We") and Third-Party Sellers ("Seller") offer you the ability to try on eligible clothing, shoes, jewellery, watches and accessories ("Fashion") or try out eligible items from the home décor, lighting, and linens categories ("Home) at home for up to 7 days ("7 Day Trial Period") before you are charged for products you keep ("Prime Try Before You Buy"). If you choose to place a Prime Try Before You Buy order, you accept the following terms and conditions ("Terms and Conditions"). Please read them carefully. Please also see our Privacy Notice, our Cookies Notice and our Interest-Based Ads Notice.
If, and then only to the extent that, the Conditions of Use and Sale of Amazon.co.uk, or other applicable terms are inconsistent with these Terms and Conditions, these Terms and Conditions will control only with respect to Prime Try Before You Buy.
OUR CONTRACT
The Prime Try Before You Buy order confirmation email is acknowledgement that we have received your order. We accept your order when we dispatch the products to you and send e-mail confirmation to you that we've dispatched the products. Prime Try Before You Buy offers you a 7 Day Trial Period. This means that you have 7 days from receipt of the products to decide whether or not to keep them. If during the 7 Day Trial Period you let us know which products you want to keep or return by selecting the relevant products in Your Orders, we will then charge you the agreed price for the products you decided to keep. This will trigger the sale of the products to you. If you decide to return products, you must return them to us within 21 days and you will not be charged for these products. If you do not send them back to us within 21 days, you will be charged for them 21 days after the end of the 7 Day Trial Period. If after the end of the 7 Day Trial Period you have not told us in Your Orders if you want to keep or return the products, you will be charged for them after the 7th day. This will trigger the sale of the product to you.
RIGHT OF CANCELLATION UP TO 14 DAYS
Unless one of the exceptions listed in section 2 of the Conditions of Sale of Amazon.co.uk applies, you can cancel your order without giving any reason within 14 days from the date of delivery of the products.
You must inform us (Amazon EU Sarl, 38 avenue John F. Kennedy, L-1855, Luxembourg) of your decision to cancel your order. You may submit your request according to the instructions and forms available on our Returns Support Centre, by contacting us, or using this form. In case you use the returns support centre, we will communicate to you an acknowledgement of receipt by e-mail. To meet the cancellation deadline, it is sufficient for you to send your communication before the 14 days’ cancellation period has expired and return the product(s) no later than 14 days from the day on which you communicate your cancellation via our Returns Support Centre. You will have to bear the direct cost of returning these product(s).

ELIGIBILITY
Eligible items will display a Prime Try Before You Buy icon. The products that are eligible for Prime Try Before You Buy and the minimum and maximum items per order may change from time to time. Not all colours and sizes of a product may be eligible for Prime Try Before You Buy.
To be eligible for Prime Try Before You Buy, you must be an eligible Amazon.co.uk Prime member and you must have a valid and accepted payment method associated with your Amazon.co.uk account. Eligibility for Prime Try Before You Buy may change from time to time in our sole discretion. Payment methods we accept for Prime Try Before You Buy orders may change from time to time in our sole discretion.
We reserve the right to accept or refuse your Prime Try Before You Buy membership to the extent permitted by applicable law.
RETURNS
When we receive a return, we will determine if the products are in acceptable condition as specified in the relevant returns policy. For Fashion, please see theAmazon Fashion returns policy. For Home, please see the Voluntary Returns Policy. If returned products are determined by us not to be in acceptable condition, we may reject the return and charge you the purchase price, or reject your request for a refund for such items. Any return of a product purchased through Prime Try Before You Buy, and the amount of any resulting refund, will be subject to the relevant returns policy. This does not affect your legal cancellation rights.
PAYMENT
We will charge you the purchase price of the products in your Prime Try Before You Buy order on the earlier of the date when the 7 Day Trial Period expires, or you elect to keep the products by completing checkout.
However, if we do not receive your returned product(s) within 21 days of the end of the 7 Day Trial Period you will be charged the purchase price of such product(s). Similarly, if we determine that the condition of your returned product(s) do not satisfy the relevant returns policy, you will be charged the purchase price of such product(s) and such product(s) will be returned to you at your cost.
You authorise us to charge any amounts owed by you under these Terms and Conditions to the payment method associated with your Prime Try Before You Buy order. If we are unable to charge the payment method associated with your order, you authorise us to update your order with another payment method in your account and to charge the payment method for any amounts owed by you.
If we are not able to charge any amounts owed by you under these Terms and Conditions to a payment method on file in your Amazon.co.uk account, we reserve the right to pursue any remedy that is available to us, including the right to suspend or terminate your Amazon.co.uk account. You agree that we and our affiliates have no liability related to the exercise of these remedies.
TITLE AND RISK OF LOSS
Title to each product in your Prime Try Before You Buy order remains with Amazon or Seller until Amazon has received full payment. If you elect to keep a product or products in your Prime Try Before You Buy order, or if you do not return a product or products within 21 days after the end of the 7 Day Trial Period , title to those products in your Prime Try Before You Buy order will pass to you when we charge you the purchase price.
Risk of loss passes to you upon delivery of your Prime Try Before You Buy products to the carrier. For returns from you to us, risk of loss passes to us upon our receipt of your Prime Try Before You Buy returns from the carrier.
APPLICABLE LAWS
These conditions are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg (with the exception subject to the exclusion of its conflict of law provisions), and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If you are a consumer and have your habitual residence in the EU or the UK, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. We both agree to submit to the non-exclusive jurisdiction of the courts of the district of Luxembourg City, which means that you may bring a claim to enforce your consumer protection rights in connection with these Conditions of Use in Luxembourg, the UK, or in the EU country in which you live. If you reside in the EU, the European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. AGREEMENT CHANGES
We reserve the right to make changes to Prime Try Before You Buy, including these Terms and Conditions at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use Prime Try Before You Buy. If any of these terms is deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining term.
