These Amazon Games and Software Terms and Conditions (“Terms”) and the Amazon.co.uk Conditions of Use & Sale (https://www.amazon.co.uk/conditionsofuse) (collectively, this “Agreement”) are an agreement between you and Amazon Media EU S.à.r.l. (with its affiliates, "Amazon", "us", or "we") regarding your use and (where applicable) purchase of certain digital games, software and other products and services from the Amazon.co.uk website or app (the website). Please read these Terms and the Conditions of Use carefully before using Amazon Services. By using Amazon Services, you signify your agreement to be bound by these Terms and Conditions. In addition, please note that third party terms and conditions may apply, as described in section 5. Please also see our Privacy Notice, our Cookies Notice and our Interest-Based Ads Notice to understand how we collect and process your personal information.
1. Products which are subject to these Terms
The following types of products which are available for purchase, download and/or access (as applicable) from the Website are subject to these Terms (together, the “Products”):
The other products and services which may be acquired using a Digital Code may include Applications, Add-On Products and Subscriptions, and may be provided by Amazon or a third party. They are referred to in these Terms as “Code Products”.
Products include any software used to access the Product, any content, documentation, ads, services, technology, data and other digital materials included in or made available through the Product (including after you download or initially access it), and through any updates and other changes and versions of the Product.
Most of the Products we make available are published by and licensed to you by third party publishers, but sometimes Amazon may be the publisher. The publisher will be the manufacturer, developer or brand name indicated on the Product detail page.
2. Purchasing Products
2.1 Geographical restrictions. Only customers from certain countries and territories are eligible to shop for Products on the Website. See this page for details. Please also refer to Product detail pages for details of additional geographical restrictions which may apply, including country and region compatibility.
2.2 In-Product Purchases. Additional Products and services which are available for purchase within a Product are not Add-On Products. We are not a party to, and have no responsibility for, any payment or purchase of products and services you make through or using a Product.
3. Accessing Product(s) after purchase
3.1 How to access Product(s). After you order a Product and pay any corresponding price and once we have accepted your order (and after the official release date, for any pre-ordered Product), you may download, redeem, use, activate and/or access the Product. We will provide you with instructions on how to download, redeem, use, activate and/or access the Product by email. For Digital Codes, we will provide you with a code which you will be required to input on a relevant third party website or into your device (such as a games console) in order to download, redeem, use activate and/or access the relevant Code Product. You are responsible for any Internet or other connection charges you may incur in connection with your download, redemption, activation, access and/or use (as applicable) of any Products and Code Products, including any free trial versions. If you are unable to download, redeem, activate, access and/or use a Product, please contact Amazon Customer Service for assistance.
3.2 Pre-Order Products. Some Product(s) are available for order in advance of their release date. If you order a pre-order Product, the Product detail page will specify the release date and we will make the Product available to you on such date. We may change the release date after you place your order but only where necessary due to circumstances outside of our control (for example, if the publisher delays or brings forward the release date). You may cancel any pre-order Product and get a full refund at any time before its release date by contacting Amazon Customer Service for assistance. You may also be entitled to cancel a pre-order Product after its release date - see section 8 for more details.
3.3 Accounts with Third Parties. In order to download, redeem, activate, access and/or use certain Products and Code Products, you may need to have or create an account with a relevant third party (such as a game platform provider) and you may need to link that account to your Amazon account. In some cases, you may be able to use your Amazon account details to log into the third party’s website or platform. Where applicable, the relevant requirements will be clear to you from the Product detail page and (if required) we will also provide you with instructions on how to set up an account with the third party and how to link it to your Amazon account when we confirm your order. Any information you provide to the third party will be subject to the third party's privacy policy or similar terms, and will not be subject to the Amazon Privacy Notice.
3.4 Online Products. Some Products are available for download to your computer or other local device, while other Products are hosted on servers and are made available for use over the Internet (“Online Products”). Online Products are hosted and maintained by the publisher or another third party. Please note that from time to time, the publisher or third party may make Online Products unavailable for access for short periods of time for maintenance or security reasons.
4. Product requirements, restrictions and ratings
Where applicable, you are responsible for ensuring before purchase that the device(s) on which you intend to download, redeem, activate, access and/or use a Product (and/or Code Product where applicable) meet any minimum system requirements that we make available on the Product detail page. Products may be subject to any use, access and other restrictions described on the Product detail page. We may provide age and content ratings for Products that publishers or other third parties provide to us or that are based on information provided by publishers or other third parties. While we require publishers to provide accurate information regarding the content of their Products, we cannot guarantee that Product ratings are accurate or that Products do not include content that is offensive, indecent, or objectionable.
5. Third party terms and conditions
5.1 All Products (except Digital Codes). Your use of a Product may be governed by the terms and conditions of an end user licence agreement between you and the publisher or other licensor of the Product (a “EULA”). If so, you will normally be required to accept the EULA when you first access the Product. The publisher or other licensor has the right to enforce the EULA against you. If you choose not to accept a EULA for a Product you must not use that Product. These Terms do not amend or supersede any EULA or other agreement between you and the publisher of a Product. Amazon is not a party to the EULA for any Product (unless Amazon is the publisher). If you receive a Product that is not accompanied by a EULA, then the publisher grants to you only a limited licence to download (if applicable), access and use the Product for (i) personal purposes, and (ii) business purposes, but only if the Product is clearly intended for business use (for example, business accounting software) and subject to any applicable restrictions stated on the Product detail page, and reserves all other rights.
5.2 Digital Codes. When you purchase a Digital Code which can be redeemed for, or used to purchase or gain access to, Code Product(s), other terms and conditions (and not these Terms) will apply in respect of your use of the Code Product(s). Such terms and conditions will be available to you on the relevant third party website when you redeem or use the Digital Code and you will normally be required to accept them before purchasing or gaining access to the relevant Code Product(s). We recommend that you check such terms and conditions prior to purchasing the Digital Code from Amazon. Amazon is not a party to such terms and conditions. If you need any technical assistance in relation to a Code Product after you have gained access to it, please contact the developer or provider of the Code Product (which may not be Amazon) for assistance.
6. Software; DRM; Information provided to Amazon
6.1 Software. We may make available to you software that you may need to install on your device or use in order to download or access Applications and/or Add-On Products purchased from the Website (“Software”). Terms contained in the Conditions of Use apply to your use of the Software (including the Additional Amazon Software Terms section), which is an Amazon Service for the purpose of the Conditions of Use.
6.2 DRM. Publishers may choose to protect their Products using a digital rights management (“DRM”) system which may be implemented through the Software or using the publisher's or another third party's DRM that a publisher provides with its Products. Software includes any software we include in a Product to enable DRM implemented through the Software, or for other purposes. You may not attempt to disable, bypass, modify, defeat, or otherwise circumvent the DRM or any other security or content protection system used in connection with the Products.
7. Subscriptions
7.1 Payment. If you purchase or start a free trial for a subscription, the duration of your subscription will be specified at the time of purchase. You can cancel your subscription at any time by visiting the “Your Memberships & Subscriptions” section within Your Account and updating your subscription settings.
7.2 Auto-renewal. Unless you notify us before a charge that you want to cancel or do not want to auto renew, you understand your subscription will automatically continue and you authorize us (without notice to you, unless required by applicable law) to collect the then-applicable subscription fee and any taxes, using any eligible payment method we have on record for you. You may turn off autorenewal and stop future payments before your next payment date by visiting ‘Your Membership and Subscriptions’ within Your Account or by contacting Amazon Customer Service.
7.3 Declined payments. If all eligible payment methods we have on file for you are declined for payment of your subscription, you must provide us a new eligible payment method promptly or your subscription will be canceled. If you provide us with a new eligible payment method and are successfully charged, your new subscription period will be based on the original renewal date and not the date of the successful charge.
7.4 Changes. We reserve the right to change the terms and conditions (including as set out in these Terms) and the fees for Subscriptions from time to time, effective as of the beginning of the next subscription term.
7.5 Termination by Amazon. We may terminate a Subscription:
7.6 Right of withdrawal up to 14 days. Unless one of the exceptions listed in section 7.8 applies, you can withdraw within 14 days. To withdraw within the 14-day period, you can cancel your subscription on Your Memberships & Subscriptions (https://www.amazon.co.uk/yourmembershipsandsubscriptions) using this process or contact customer service (https://www.amazon.co.uk/contact-us). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
7.7 Effects of withdrawal. If you withdraw in accordance with section 7.6, we will reimburse all payments received from you for the relevant Product(s) in your order without undue delay and at the latest within 14 days from the day on which we received your withdrawal notification.
7.8 Exceptions to the right of withdrawal. The right of withdrawal does not apply to certain types of product by law, including:

8.1 Termination and suspension. Your rights under these Terms will automatically terminate if you materially fail to comply with these Terms or the Conditions of Use, your use of a Product breaches any applicable law, or we have reasonable grounds that you have acted fraudulently. A publisher (or with respect to Code Products, the relevant third party developer or provider) may also terminate or suspend your use or access to a Product or Code Product if you materially fail to comply with the EULA applicable to the Product or other terms and conditions applicable to use of the Code Product. In case of termination or suspension, where technically possible we and/or a relevant third party may immediately permanently revoke or temporarily disable your access to the relevant Product(s) and/or Code Product(s) without notice to you and without refund of any amounts paid in respect of such Product(s). You must cease all use of the Software if your rights under these Terms are terminated. Amazon's failure to insist upon or enforce your strict compliance with these Terms or the Conditions of Use will not constitute a waiver of any of its rights.
8.2 Applicable Law and Liability. Any dispute or claim arising from or relating to these Terms or your purchase of a Product is subject to the Applicable Law and Our Liability sections in the Conditions of Use. References in those sections to the Conditions of Use or “these conditions” shall, for the purposes of these Terms only, be interpreted as referring to these Terms. Nothing in these Terms limits or excludes our responsibility to you where it would be unlawful to do so. This includes responsibility for fraudulent representations made by us, for death or personal injury caused by our negligence, or for breach of your legal rights in relation to a Product.
8.3 Amendments to these Terms. We reserve the right to make changes at any time to these Terms, or any part of them, for legal or regulatory reasons, to make them clearer or easier to understand, and/or to reflect any changes we make to the Website or any Products we offer by posting the updated versions on Amazon.[xx], or such other website or application that is used to provide the Product. You will be subject to the Terms in force at the time that you order a Product from us. You may at any time, cease using any Product, terminate your Amazon account or the relevant Product for any reason, including in the event of any changes. If any of these Terms is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
